This promotion is sponsored by Shane Yellowbird Music Inc. ("SYMI", "we" or "us"). By entering the Promotion, you agree to comply with and be bound to the following official contest rules.
1. Eligibility
The 2009 Travel Prize promotion (hereinafter referred to as "the Promotion" or "the Prize") is open only to legal residents of Canada living in Canada (excluding residents of Quebec), who are 21 years of age or older at the time of entry, possess a Canadian passport valid at time of travel, and are legally able to travel to and from Canada and the United States. The travel companion must also be twenty-one (21) years of age or older at time of travel, possess a Canadian passport valid at time of travel, and are legally able to travel to and from Canada and the United States.
Corporations are not eligible. Employees, officers and directors of SYMI, its legal representatives, and each of its affiliates, parents, subsidiaries, advertising, promotional, fulfillment and marketing agencies, and their immediate families (and those living in their respective households) are not eligible to enter or claim prizes in the Promotion.
By entering the Promotion, participants agree to release, discharge and hold harmless SYMI, CTM Canada, the Grand Ole Opry, On Ramp Records, and its legal representatives, affiliates, subsidiaries, parents, agencies and its respective officers, directors, employees and agents, from any and all damages that may arise out of, or in connection with, participation in the Promotion, or out of the acceptance, use, misuse or possession of prizes. By participating, you agree to these Official Contest Rules and to the Promotion winner(s) selections and decisions of the SYMI staff judges, which are final and binding in all respects. Promotion void where prohibited by law and is subject to all federal, provincial and local laws, rules and regulations.
2. Prize
ONE (1) PRIZE: A trip for two (2) to Nashville, Tennessee. Prize package includes round-trip coach-class air transportation for two (2) from a major airport near winner's home (determined by SYMI in its sole discretion) to Nashville, Tennessee; round-trip ground transfers between airport and hotel; two (2) nights' hotel accommodations, (single room, double occupancy); a tour of Nashville and the Country Music Hall of Fame.
The prize winner and companion must travel together on the same flights.
The travel will take place departing Friday, November 20, 2009 and return Sunday, November 22, 2009. Travel must be roundtrip. SYMI will determine airline and flight itinerary in its sole discretion. No refund or compensation will be made in the event of the cancellation or delay of any flight. Travel and accommodations are subject to availability. Travel is subject to the terms and conditions set forth in this Promotion, and those set forth by the SYMI's airline carrier of choice as detailed in the passenger ticket contract.
All expenses and incidental travel costs not expressly stated in the package description above, including but not limited to, ground transportation, meals, incidentals, passenger tariffs or duties, surcharges, airport fees, service charges or facility charges, personal charges at lodging, security fees, taxes or other expenses are the responsibility solely of winner.
Travel companion must execute liability/publicity releases prior to issuance of travel documents. Travel restrictions, conditions and limitations may apply. SYMI is not responsible if any course or tour is delayed, postponed or cancelled in which event that portion of the prize is forfeited in its entirety and no substitution will be provided except in SYMI's sole discretion. SYMI will not replace any lost, mutilated, or stolen tickets, travel vouchers or certificates.
The Prize is non-transferable and cannot be converted into cash.
The odds of winning a prize depend on the number of eligible entries received during the Promotion Period.
3. How to Enter
NO PURCHASE NECESSARY TO ENTER OR WIN PRIZE. A PURCHASE DOES NOT INCREASE YOUR CHANCES OF WINNING.
The promotion begins at 7 p.m. (Central Time ["CT"]) on October 23, 2009 and ends at 4:00 p.m. CT on November 13, 2009. To enter, visit www.shaneyellowbird.com, (the "Shane Yellowbird Website"), fill in the online entry form and submit it in accordance with the on-screen directions. All online entries must be received by 4:00 p.m. CT on November 13, 2009 to be eligible. Only one online entry per person per email address per day. If an entrant uses multiple email addresses to submit more than one online entry for a given day, only the first online entry for that day will count.
All entries become the property of SYMI and will not be returned. When you enter at the Shane Yellowbird Website, you may be asked to consent to receive promotional emails and reminders from Shane Yellowbird, On Ramp Records, CMT Canada, and the Grand Ole Opry. Consenting to receive such emails is optional and does not have to be agreed to in order to be eligible to enter the promotion and does not improve your chances of winning. In the event you do consent to receive these emails, the use of such emails shall be subject to the privacy policy of the each organization, which is available on each respective website.
4. Drawing and Notification
The Winner will be selected from among all eligible entries received in a random drawing at the conclusion of the promotional period (October 23, 2009 – November 13, 2009). Odds of winning the prize depend on the number of eligible entries received. In case of dispute as to identity of a winner, such entry will be declared made by the registered user of the email account, and if a prize is won, and such registered user is a valid entrant, the prize will be awarded to such registered user. The "registered user" is the natural person to whom an email address is assigned by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted email address. All entries will be deemed to have been made by the registered user of the email address.

6. Prize Conditions
Prize winner and his/her travel companion may be required to sign, notarize and return an Affidavit of Eligibility and Liability/Publicity Release and provide any additional information that may be required by SYMI, except where prohibited by law. Except where prohibited by law, potential winner must return all required documents (together with travel companion's required documents) within 48 hours following attempted notification or prize may be forfeited. Return of any prize/prize notification as undeliverable, or inability of SYMI to contact a potential winner may result in disqualification and selection of an alternate winner by random drawing.
7. Publication
SYMI, CMT Canada, The Grand Opry, or its affiliates, partners and promotional agencies have the right to use the winner's name, city address and likeness for advertising purposes, without further compensation other than the prize awarded, upon the winner's acceptance of the prize.
8. General Conditions
SYMI reserves the right to cancel, suspend and/or modify the Promotion, or any part of it, if any fraud, technical failures or any other factor beyond SYMI's reasonable control impairs the integrity or proper functioning of the Promotion, as determined by SYMI in its sole discretion. SYMI reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Promotion or to be acting in violation of these Official Rules or any other Promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, SYMI reserves the right to seek damages from any such person to the fullest extent permitted by law. SYMI's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
9. Limitations of Liability
The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Promotion; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Promotion; (4) technical or human error which may occur in the administration of the Promotion or the processing of entries; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Promotion or receipt or use or misuse of any prize. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant's sole remedy is another entry in the Promotion, provided that if it is not possible to award another entry due to discontinuance of the Promotion, or any part of it, for any reason, SYMI, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, SYMI reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.
10. Disputes
Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the courts in the Province of Alberta Canada, any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and SYMI in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the Province of Alberta, without giving effect to any choice of law or conflict of law rules (whether of the Province of Alberta or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Province of Alberta.
